1. Definitions
1.1 Software:
Refers to the Yogasana Ranking System software, including all updates, enhancements, and associated documentation.
1.2 User:
Refers to the individual or entity using the software.
1.3 Owner:
Refers to the creator and licensor of the Yogasana Ranking System Software.
2. License Agreement
2.1 The YRS Software is licensed, not sold. The Owner grants the User a limited, non-exclusive, non-transferable license to use the Software for personal or organizational purposes, as per the terms of this agreement.
2.2 The User may not distribute, sublicense, rent, lease, or sell the Software to any third party without prior written consent from the Owner.
3. User Obligations
3.1 The User agrees to use the Software only for lawful purposes and in accordance with these Terms and Conditions.
3.2 The User may not modify, reverse engineer, decompile, or disassemble the Software.
3.3 The User is responsible for maintaining the confidentiality of their login credentials and ensuring that the Software is not misused.
4. Data Privacy
4.1 The Software may collect and process performance data (e.g., intensity and stability scores) for ranking calculations.
4.2 The Owner respects the User’s privacy and complies with applicable data protection laws. All collected data will only be used for the purposes specified in the Yogasana Ranking System.
4.3 Users must ensure that any personal data shared through the Software complies with data protection laws and that they have consent from relevant parties.
5. Intellectual Property
5.1 The Software, including all associated designs, algorithms, calculations, and documentation, is the intellectual property of the Owner.
5.2 The User acknowledges and agrees that the Owner retains all ownership rights, titles, and interests in the Software.
5.3 Unauthorized use of the Software, including but not limited to copying, modifying, or creating derivative works, is strictly prohibited.
6. Disclaimer of Warranties
6.1 The Software is provided “as is” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
6.2 The Owner does not guarantee the accuracy, reliability, or completeness of the rankings or calculations generated by the Software.
7. Limitation of Liability
7.1 The Owner shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Software.
7.2 The User assumes full responsibility for any decisions or actions taken based on the results or rankings generated by the Software.
8. Updates and Modifications
8.1 The Owner reserves the right to update or modify the Software and these Terms and Conditions at any time.
8.2 Users will be notified of any significant changes, and continued use of the Software constitutes acceptance of the updated Terms and Conditions.
9. Termination
9.1 The Owner reserves the right to terminate the User's access to the Software in case of a breach of these Terms and Conditions.
9.2 Upon termination, the User must uninstall and cease all use of the Software.
10. Governing Law
10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Jaipur, Rajasthan.
10.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan Only.
